TEN 5th Annual Melbourne Wills & Estates Conference, 1-2 March 2018

Richard will be presenting a paper on “Statutory Wills: Navigating the Challenging Path Ahead for Practitioners” at the TEN 5th Annual Melbourne Wills & Estates Conference, on 1 March 2018.

The paper will address recent cases and emerging issues, including:

  • The role of a litigation guardian – do they have the last say on the terms of the proposed Will?
  • What steps should be taken to gauge the views of the proposed testator, and will those views carry weight?
  • Heavily contested applications – do the principles vary?
  • Should the Statutory Will be made now, or can the problems be resolved post-death, by way of a contested probate proceeding or family provision application?
  • Costs – who pays?
